Newmerix Corp. (“Newmerix”, “us”, or “we”) takes the privacy and protection of your personal information seriously. By visiting the Newmerix websites, located at http://www.newmerix.com, http://www.testingbestpractices.com, and http://www.changemanagementbestpractices.com (collectively, our “Websites”), and/or using the services we offer through our Websites (our Websites and the services we offer are collectively referred to as the “Services”) you acknowledge that you accept the practices and policies outlined in this privacy policy (“Privacy Policy”), which is incorporated into the Terms of Use http://www.newmerix.com/tou.php.

User Consent

By using the Services or submitting Personal Information through the Services, you agree to the terms of this Privacy Policy and you expressly consent to the processing of your Personal Information according to this Privacy Policy.

Your Personal Information may be processed by us in the country where it was collected as well as other countries (including the United States) where laws regarding processing of Personal Information may be less stringent than the laws in your country.

Collection of Information

This Privacy Policy describes Newmerix’s use of Personal Information and Anonymous Information that we collect when you use our Services. This Privacy Policy does not apply to the use of your Personal Information by third parties that Newmerix does not own or control, or to individuals that we do not control or manage.

• “Personal Information” which is information about you that is personally identifiable to you like your name, postal address, e-mail address, phone number, Newmerix IDs and passwords, as well as other non-public information that is associated with the foregoing.
  
  
• “Anonymous Information” which is information that is not associated with or linked to your Personal Information. Anonymous Information does not permit the identification of individual persons.

• When you sign up to receive our newsletter and information about product and service offerings, including demonstrations of our products, and to enroll in our web-based seminars we will collect your name, postal address, telephone number, and email address.
• When you contact us by sending us an e-mail, we will collect any information that is contained in your e-mail.
• Our registration process permits access to certain features of our Services and requires you to provide Newmerix with your name, a valid e-mail address, postal address, and phone number as well as a username and password of your choice.

In general, Personal Information you submit to us is used by us either to respond to requests that you make relating to our products and services, enhance our product and service offerings, better tailor the features, functionality, performance and support of those products and services, and to communicate with you about our products and services (though we provide ways for you to opt-out of those communications as described in this Privacy Policy).

We may create Anonymous Information records from Personal Information by excluding information (such as your name) that make the information personally identifiable to you.  We may use this Anonymous Information to analyze usage patterns so that we may enhance our Services.  We reserve the right to use and disclose Anonymous Information to third parties in our discretion.

You can choose not to provide us with certain information, but this may limit the features of the Services you are able to use.

Personal Information Collected Via Technology

As you use the Services, certain information may also be collected passively, including your Internet protocol (IP) address, browser type, and operation system.  When you use Newmerix, our Web server sends a small text file called a “Cookie” to your computer which collects small bits of information about your use of our Websites.  When you return to Newmerix, the information in the cookie helps us to recognize your browser and to and provide appropriate information.  We may use information from Cookies collected about the use of our Websites to help us improve the Services and other products and services we provide.  If you set your browser to refuse Cookies, the Services may not work correctly.

Feedback

If you provide feedback to us, we may use and disclose such feedback for any purpose, provided that we do not associate such feedback with your Personal Information. We will collect any information contained in such feedback and will treat the Personal Information in it in accordance with this Privacy Policy.

Disclosure of Personal Information

Except as otherwise stated in this Privacy Policy, we do not share any of your Personal Information with unrelated third parties, unless you ask or authorize us to do so.  We may share your information with our subsidiaries, third-party service providers, or contractors who work on behalf of or with us to support your customer relationship with Newmerix.  We may disclose Anonymous Information (which may include, but is not limited to, browser type, URLs visited, and search terms entered but does not include any client-identifying information) to our customers and other third parties, in our discretion.

We may share some or all of your Personal Information with any parent company, subsidiary, joint venture partner, or other company under common control with us (collectively, “Affiliates”) in which case our Affiliates will be required to honor this Privacy Policy. If Newmerix is acquired by another company, that company will possess your Personal Information and it will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.

Due to factors beyond our control, we cannot fully ensure that your Personal Information will not be disclosed to third parties.  For example, we may be legally obligated to disclose your Personal Information to the government or third parties under certain circumstances, or third parties may circumvent our security measures to unlawfully intercept or access your Personal Information.

Choices Regarding Personal Information

Unsubscribe instructions will accompany each newsletter or promotional communication you receive from us. You may also indicate in your account preferences that you do not wish to receive newsletters or other promotional communications from Newmerix. 

We will send you service-related announcements (such as, but not limited to, notices of any updates to our products, the Services, the Terms of Use, or this Privacy Policy) when it is necessary to do so.  You may not opt-out of these communications, which are not promotional in nature, but if you do not wish to receive these announcements, you have the option to deactivate your account, which involves termination of the Terms of Use, which can be found at http://www.newmerix.com/tou.php.  When we delete information about you, it will be deleted from our active databases but may remain in our archives.

Links to Other Sites

The Services contain links to other websites that are not owned or controlled by Newmerix. The provision of such links is for your convenience and does not signify our endorsement of such websites or location or its contents. We have no control over, do nor review and are not responsible for the privacy policies of or content displayed on such other websites. We are also not responsible for the opinions expressed by other registered members on the Services. Please be aware that the terms of our Privacy Policy do not apply to any outside websites.

Security and Confidentiality

Newmerix has put in place commercially reasonable and appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online. However, no company, including Newmerix, can fully eliminate security risks associated with Personal Information.

Changes in this Privacy Policy

This Privacy Policy is a living document.  We reserve the right to modify this Privacy Policy at any time. If we make material changes to it we will post those changes to this Privacy Policy, our Websites, and other places we deem appropriate so that you are aware of what Personal Information we collect, how we use it, and under what circumstances, if any, we disclose it.
